The prices of this website are public sale and valid except for possible typographical or printing errors.

In this communication channel (catalogue or website) the duration, itinerary, price, supplements, minimum group and services included in the trip are indicated.

Due to the advance notice with which it is published and the limited space available, the complementary information and possible modifications (if any) will be reflected in the specific information dossier for each trip, which will be delivered to the client, and which, together with the general conditions , act as the final contract. For the interpretation, application or claim of the same, both the passenger and the organizing agency expressly submit to the Courts of Alicante, waiving any other jurisdiction.

The General Conditions that are indicated below regulate the access and use of the URL www.breezetours.es (hereinafter, the Web)

These General Conditions will be incorporated into all contracts made through the Website www.breezetours.es , and must be accepted by Users who decide to contract any Service offered or advertised through it.

The User agrees in the case of wanting to use any of the Services offered via this Website to:

  1. Read these General Conditions in their entirety.
  2. Accept them prior to any use you make of it.
  3. Comply with the obligations contained in these General Conditions.
  4. Print or save, on a storage medium, a copy of these General Conditions to be able to consult them in the future prior to any Reservation.

Article 154. Binding nature of pre-contractual information.

  1. The information provided to the traveller in accordance with letters a), c), d), e) and g) of article 153.1, will form an integral part of the package travel contract and will not be modified unless the contracting parties expressly agree otherwise. . The organizer and, where appropriate, the retailer, before the conclusion of the package travel contract, will communicate to the traveller, in a clear, understandable and prominent way, all changes to the pre-contractual information.

ALL THE INFORMATION INCLUDED IN THE PRESENT PRECONTRACTUAL OFFER MAY SUFFER CHANGES THAT WILL BE COMMUNICATED TO THE TRAVELER / CUSTOMER A MAXIMUM 21 DAYS BEFORE THE CELEBRATION OF THE COMBINED TRAVEL CONTRACT. (Article 154 of Royal Decree-Law 23/2018, of December 21, on the transposition of directives on trademarks, rail transport and package tours and related travel services).

 

ORGANIZATION

The technical organization of the trips included in this program corresponds to the travel agency Breeze Tours SL, with registered office at Calle Alemania, 34 Entresuelo D, 03003 Alicante (Spain), with CIF B67658682 and Tourism License CV-Mm2385-A, registered in the Mercantile Registry in Volume 4421, page 105, entry 1 with page A-176885.

CONTRACT CONDITIONS

The reservation of any of the trips included in this website implies the total acceptance of these general conditions, which are considered automatically incorporated into the contract, without their written transcription being required.

REGISTRATION

At the time of registration or reservation, 25% of the total amount of the trip must be deposited, not considering any committed place until said deposit is made. The remaining 75% must be paid at least 30 calendar days before the departure date of the trip, considering, otherwise, that the client voluntarily withdraws the reservation, which will entail cancellation costs. The percentage of the deposit to be made to make the registration, may vary according to the contracting conditions of each provider, and a higher or lower amount may be required according to conditions, said percentage will be communicated at the time of making the reservation to the client. In the event that a person registers another / s, he / she assumes the full content of these general conditions on their behalf.

PRICES

Prices are based on rates and currency changes based on € Euros, except for destinations where the currency is the US DOLLAR (dated January 1 of the current year) and other currencies. These prices are subject to possible modifications in cases of increase in the exchange rate of the currency applied to the trip, the cost of transport (including the cost of fuel) or the fees and taxes related to certain services (such as landing taxes, and disembarkation in ports and airports). Prices may be revised up to 21 calendar days before the scheduled date of the trip.

When Breeze Tours is forced to significantly modify and increase the price of the package trip for reasons other than those expressed in the previous paragraph, it will notify the consumer as soon as possible (in writing or by any means that allows evidence of the communication made), so that you can choose to accept the supplement or cancel the reservation or the contract (if it has been formalized).

HOW DO WE PROTECT YOUR CREDIT CARD PAYMENT?

Breezetours.es uses a server based on one of the most reliable secure payment systems on the Internet: the SSL (Secure Socked Layer) security protocol. (For more information, visit www.ssl.com).

All your personal data and the information you transmit to us travels in encrypted form through the network, and is protected and encrypted before being sent for processing.

For payment with Visa and Mastercard, only CES (Secure Electronic Commerce) transactions will be accepted. After verifying that the card is attached to the CES system, the system will contact the bank that issued it so that the buyer authorizes the purchase. Once the bank confirms the authenticity, the card will be charged. Otherwise the order will be cancelled.

The payment gateway that we use for your credit card payment is Banco Santander, which encrypts your data through the 256-bit SSL protocol. Our system does not store any bank data of your credit card, but goes directly to the Ecommerce POS (Point of Sale Terminal) of the Bank.

WHAT IS SSL?

The latest advances in browser and server technology have made it easy to use web services without concerns related to wire fraud. An example of this is Secure Sockets Layer (SSL), developed by Netscape, a security protocol submitted to the Internet Engineering Task Force (IETF) as an Internet draft. Basically, the protocol allows the browser and the server of a web session to authenticate each other and protect the information that will subsequently flow between both points.

INCLUDED SERVICES

They are specified in each trip and in the accessory information provided. In case of modification of the circuit before departure, the services included and not included will be taken into account in the informative dossier. Any service not specified as “included” is considered “not included”.

DOCUMENTATION

Breeze Tours will inform about the official documentation and the sanitary requirements necessary for the trip; however, it will be the sole and exclusive responsibility of the client both the formalization of the mandatory documents and the completion of the sanitary measures. In those cases where it is the organizing agency that takes care of the visa processing, the price of said management will be separate from the price of the visa and the price of the trip and the fact that the documentation is lost or lost will not be the responsibility of the organizing agency. LUGGAGE

Breeze Tours is not responsible for incidents related to luggage and personal effects of its clients. Their transportation will be at the risk and expense of the traveller. All customers are recommended to be present at all loading and unloading manipulations of their luggage. In air transport, the luggage allowed per passenger will be that established by each airline. In land transport, the luggage allowed per traveller will be 1 package that does not exceed 18 Kgs.

In both cases, the penalty or discomfort that the fact of exceeding said weight may entail will be the responsibility of the client, in no case Breeze Tours or its representative at destination.

Breeze Tours will not assume responsibility for the loss or deterioration that luggage may suffer while it is transported by porters or pack animals, during the development of trekking or expeditions.

Regarding air, sea or river transport, the conditions of the transport companies apply, with the passenger ticket being the only binding contract between the aforementioned companies and the passenger. In the event of any delay, loss or damage to your luggage, it is recommended to present the appropriate claim to the transport company on the spot (before leaving the airport or port).

PRESENTATIONS ON DEPARTURE

In air sections we recommend the presentation to boarding at the airports three hours before the flight departure. Passengers must reconfirm with the travel agency, within 48 hours prior to the scheduled departure, the following points: the meeting point, the date, the time and the flight number.

Departures by coach will be informed in advance of the collection points and scheduled presentation times by the client.

If this reconfirmation is not made, Breeze Tours declines all responsibility in case of alterations to the information given previously, (offers, cruises, cheap airfares, minimum groups …) and the cancellation costs will be those required by the respective providers.

WITHDRAWAL BY THE CLIENT

If the client desists from the trip, after the formalization, at least, of the deposit required to consider the reservation firm, he will have to compensate Breeze Tours with the payment of the management costs (caused to the selling agency), the cancellation costs justified (caused to the organizing agency and tourism providers) and a penalty consisting of 50% of the total amount of the trip if the cancellation occurs between 15 and 10 calendar days prior to the start date of the trip, 75% if it occurs between 10 and 3 calendar days, and 100% if you withdraw within the 3 calendar days remaining on departure.

The previous penalties and compensation will not apply when the client subrogates another person in his place as long as the service provider companies do not prevent it and the modification is made more than 5 calendar days before the departure date. In this case, the agency must be compensated with 5% of the total price of the trip in addition to the expenses incurred to carry out the replacement.

These assumptions will be without effect if they are contemplated in the coverage of the travel and cancellation insurance contracted.

CANCELLATION INSURANCE AND / OR EXTENDED COVERAGE

BREEZE TOURS offers COVID19 insurance on all its trips with specific coverage that contemplate cases of cancellation and / or interruption expenses of the trip, it is informed in detail of the amounts covered in the insurance policy. In addition, the User is offered the possibility of contracting Cancellation Insurance or other modalities with broader coverage. BREEZE TOURS recommends the subscription of insurance with the maximum coverage, which will be effective at the time of confirmation of the Reservation. BREEZE TOURS recommends reviewing in addition to the General Conditions, the Particular Conditions thereof, as well as the exclusions provided therein, prior to contracting.

MODIFICATION OF THE TRIP BY THE ORGANIZER

When Breeze Tours is obliged to significantly modify the essential elements of the package travel contract after it has been perfected and before the departure date of the trip, it must notify the client in writing as soon as possible so that the client can choose to terminate the reservation or the contract, with the right to a full refund of the amounts paid, or to accept the consequences of the modification of the initial trip.

In the event that the client does not communicate his decision in writing within three business days of notification, it will be understood that he opts for the cancellation of the reservation or the contract.

Sufficient causes for the modification of the trip are considered cases of force majeure (extraneous, abnormal and unforeseeable circumstances) and when the number of people required to carry out the trip does not attend. When such circumstances arise, there will be no compensation whatsoever.

In the event that the client opts for the termination of the contract according to the preceding paragraphs, or Breeze Tours finally decides to cancel the trip, the consumer may choose between a full refund of the amounts paid, or, if Breeze Tours can offer it, to another Package trip of equivalent or higher quality. If the offered trip is of inferior quality, Breeze Tours will reimburse the client for the price difference.

If during the trip an important part of the contracted services are not provided or could not be provided, the organizing agency will adopt the appropriate solutions for the continuation of the trip, without a price supplement for the client, and, where appropriate, will reimburse this is the amount of the difference between the benefits provided and those provided. In the event that the solutions are unfeasible or the client does not accept them for valid reasons, the organizer will provide a means of transport so that the client can return to the point of origin and, where appropriate, will compensate the consumer.

Any service not provided will be reimbursed upon return from the trip, upon presentation of the corresponding receipt issued by the person or entity responsible.

No refund will be made for services not used voluntarily by the customer, whatever the cause of non-use.

In the trips contracted with a sailing and / or motor boat, the captain or skipper responsible, reserves the right to vary or alter destinations, routes or stays in ports, according to weather conditions, prior information to clients, ensuring that their security, without the client having the right to claim and / or compensation.

CONTRACTUAL CONDITION

Breeze Tours may suspend the realization of those trips subject to a minimum number of 15 participants, when this is not reached. The suspension must be communicated to the registered clients at least 10 calendar days in advance of the scheduled departure date. In this case, the client will be entitled to a refund of the amounts paid for the trip, but will not be entitled to any compensation.

Breeze Tours reserves the right to admit or expel those people who, in its objective criteria, do not meet the necessary requirements to carry out the trip or who with their actions hinder the smooth running of the trip and the harmony in the coexistence of the group.

ITINERARY AND HOTEL MODIFICATIONS DURING THE TRIP

The definitive itinerary detailed in the program and in the technical sheet may be modified. The CLIENT expressly accepts the modifications in situ of that itinerary that Breeze Tours can carry out for the proper development of the trip and for just cause. Changes made due to weather conditions, unforeseen impositions of the providers to the area or for reasons of the limited local infrastructure are expressly accepted as long as it does not involve the breach of any of the services included in the contracted combined trip.

The CLIENT also accepts the change of hotel establishment that takes place in situ provided that the enjoyed has a category or characteristics equal to or greater than that established in the initial itinerary. In the event that clients must be accommodated in hotels of a lower category than the one contracted, upon their return the agency will reimburse them for the price difference in the event that it exists.

RESPONSIBILITIES

Breeze Tours is liable for the consequences arising from non-performance or poor performance of the contract in proportion to its intervention in the management of the package.

However, it will be exempted from this responsibility when it has been due to force majeure (foreign, abnormal and unforeseeable circumstances), due to a fact that neither Breeze Tours nor the suppliers have been able to avoid or when the cause is attributable to the client or a third.

The client is obliged to notify Breeze Tours, as soon as possible and in writing, of any breach in the performance of the contract that he has verified on the spot.

LIMITATION OF LIABILITY FOR OVERBOOKING, CANCELLATION OR GREAT DELAY

When the airline cancels a flight or incurs a long delay, it will be responsible for providing due assistance and attention to the affected passengers, having to bear the costs of meals, calls, transportation and overnight stays if applicable, by virtue of the provisions of Regulation CEE 261/04, which establishes the common rules on compensation and assistance of air passengers in cases of denied boarding and cancellation or long delay in flights.

In case of flight cancellation, it will also be obliged to pay the corresponding compensation to the passenger, as well as to reimburse the price of the plane ticket if the passenger chooses this option. If the cancellation is due to extraordinary circumstances that could not have been avoided even if all reasonable measures had been taken, the air carrier in charge of making the flight will not be obliged to pay the compensations, but to provide due assistance and attention to the affected passengers and reimburse them the price of the ticket if they choose this option.

When the lack of connection of the flights, even due to time changes of the participating airlines, forces to spend the night or make a long wait, the expenses derived from this fact, both for accommodation and meals and transport will be on account of the air carrier causing the overbooking, cancellation or delay, by virtue of the provisions of the CEE 261/04 regulation, which establishes the common rules on compensation and assistance of air passengers in cases of denied boarding and cancellation or long flight delay.

VALIDITY

These general conditions clauses have been drawn up on January 1, 2023 and are valid indefinitely.
